BEFORE USING OUR WEBSITE, PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY.

This document serves as Counseling Washington’s “Terms of Use and Services” and outlines the conditions under which you may use this website, an interactive on-line service owned and operated by Counseling Washington to inform and assist clients as well as provide a service to the counseling community. Site information is provided by Counseling Washington and other third parties including but not limited to Counselors and Therapists who advertise on the website otherwise known as “Members” of Counseling Washington.

Herein the term “Viewer” refers to the consumers who are visiting Counseling Washington’s website who view, obtain information or referrals of Members offering counseling or counselor-related services in the State of Washington.  We are using the term “Members” for those clients who are advertisers, some with private practices, who have chosen to advertise their private practice businesses or counselor-related services on the Counseling Washington website.

By virtue of use of the site, it is understood and you agree to the terms of use and services herein, including the Site Privacy Policy, that forms a binding agreement between you and Counseling Washington. By accessing the Site, it indicates your acceptance of these Terms of Use and Services.

Acceptable Use

Counseling Washington’s primary goal is two-pronged: (1) to provide current pertinent information to consumers looking for counseling and counseling-related services congruent with (2) helping counselors throughout Washington State build their private practices, groups and agencies.

Counseling Washington is not affiliated with any city, county, or state body, although there are often links to such entities to help counselors find information rather we are a privately owned organization. Counseling Washington is not a part of Washington State’s Health Department or any law enforcement agency.

“Counseling Washington” is the primary name for all of our business activities.   Our legal entity is COUNSELINGSEATTLE, LLC; however to reflect trends and expand our offerings, “Counseling Washington” is our Registered Trade Name.   For the purposes of clarity within this document, COUNSELINGSEATTLE, LLC and all its networked Satellite websites will henceforth be referred to as “Counseling Washington”.  It is implied when using “Counseling Washington” that all Counseling Washington satellite sites are included. Two or more different names may be seen when perusing any of Counseling Washington’s satellite-websites because they will be linked to each other.  As time progresses, more names will be added to the satellite network. Any of our networked satellite websites will always clearly indicate that they are part of Counseling Washington’s Satellite Network.  These companies are privately owned and operated by Floyd Else, MA, LMHC (ret.), webmaster, while being maintained by his staff.

The information on Counseling Washington, or any websites within our network, is not intended to treat, diagnose, cure or prevent any disease and is provided solely for educational or awareness purposes. Always seek the advice of your physician with any questions regarding a medical condition.

Counseling Washington also tries to inform the public with continued industry changes to credentials and what these credentials mean. In an effort to provide the most accurate information, the “Counseling Related Acronyms” document is continually updated adding new credentials.

Advertising on these pages is open to all qualified, licensed, mental health and addictions therapists and other counseling-related advertisers at low fees to help defer the cost of maintaining the site. Advertising may include links to other websites; however Counseling Washington cannot be responsible for the outcome of clicking on any of the links on the site. Please Contact Us to report broken or unexpected links upon discovery. 

The viewer assumes full responsibility for communications with any therapist contacted through Counseling Washington. Counseling Washington shall in no event be liable for any decision made or action taken in the reliance on information provided on this site.

Viewing information or seeking services from this site is the sole responsibility of the viewer. Viewers who believe they have found an error, misrepresentation, or incomplete or outdated material should report this to Counseling Washington immediately. If you feel that you have suffered damage or loss due to viewing this site, we sincerely apologize. Liability is limited to your actual cost of viewing this site (nothing), and Counseling Washington’s intent is to provide helpful educational material.

The Counseling Washington counselor locator is not intended as a tool for verifying the credentials (instead refer to Washington State's Provider Credentials Look-up System), qualifications, or abilities of any therapist lists. Inclusion in the Counselor Locator does not imply recommendation or endorsement nor does omission from the counselor locator imply Counseling Washington’s disapproval. Counseling Washington does not warrant or represent that the Counselor Locator service or any part of the site is accurate or complete.  

Rules of Conduct

Counseling Washington is the sole interpreter of any and all rules as described in these Terms of Use. Revocation of access, suspension or termination is at the discretion of Counseling Washington of Users or Members who violate the rules set forth herein. If action is deemed necessary or appropriate, Counseling Washington reserves the right to take action regarding materials or membership.

Posting Rules

Advertisers or Members may not include in their materials that post, the following: (1) competitor URLs or URLs from other directory or rating sites (2) copyrighted material that is not your own or expressly permitted by the copyright owner (3) other materials that infringe on copyright or intellectual property, or that may violate the privacy or public rights  or others (4) anything that is sexually explicit, obscene, libelous, defamatory, threatening, harassing, abusive, or hateful; or anything considered to be embarrassing or offensive to any entity including but not limited to another person or group (5) anything that is misleading or misrepresents earned credentials, licenses or other false listing information.

Materials may also not: Impersonate another person, living or dead; include false or misleading information; include solicitation of businesses; include chain letters, pyramid schemes, etc.; or include opinions whether commercial or otherwise. These materials may also not encourage users to use a third party for more information or charge a fee.

In an effort to determine and maintain compliance with this agreement, Counseling Washington has the right to monitor any content on Counseling Washington’s website, including but not limited to chat rooms, blogs, forums, and client emails, and any operating rules established by Counseling Washington and to satisfy any law, regulation, or authorized government request.

Counseling Washington, at its sole discretion, reserves the right to edit, refuse any post or remove any material submitted to or posted on its website.  Therefore, Counseling Washington shall have sole discretion and right to remove any material that it finds to be in violation of the agreement hereof or otherwise objectionable.

Conduct Rules

You are only to respond to postings for the manner expected. Soliciting business is prohibited.

Encouraging others to send unsolicited commercial email to our users or Members is prohibited.

Postings or conduct that is inappropriate should be reported immediately to Counseling Washington.  See our Contact Us page for our email and mailing address.

No editing, deletions or revisions of any material posted by anyone other than themselves is allowed.

Conduct that inhibits any user from utilizing or enjoying the website is prohibited.

Counseling Washington is not obligated to monitor the conduct of its users, however investigative responses may be the result of any real or perceived violations of these policies.

Security Rules

Whether attempting to violate or violating the security of our website by Users or Members is strictly prohibited. Such attempts include but are not limited to: (1) accessing the server or logging into an unauthorized account;(2) unauthorized testing or scanning of the website; (3) interfering or attempting to interfere with the host, user or network by means of submitting a virus, or any other means that would otherwise overload or compromise its normal functioning; (4) sending Members unsolicited information, ads, e-mails, etc; (5) Falsely representing Counseling Washington by using its logo or name or misrepresenting the company in any way by use of a header within any e-mail or news posting.

Civil or criminal liability may be the result of violation of these Security Rules. Users involved or suspect will be investigated in cooperation with the law with regards to prosecution.

Registration Rules

All users who wish to advertise must register. Once registered, user can select as many services as desired and listings will bill immediately upon submission. This date will also become the User’s anniversary date by which all subsequent billings will trigger on a monthly basis. Counseling Washington, upon good faith, agrees to post the listing immediately however reserves the right to review the user as a member or revoke the listing if the rules as stated herein are not followed. Counseling Washington will make its best effort to contact the User with any concerns, discrepancies or clarifications at its own choosing. At the time of registration, true and accurate information will be requested of you including but not limited to your name, email address and phone number. Your information is kept private and will not be shared or sold to third parties as per our Privacy Policy.

At the time of registration, you will select your own UserID and password. This information is intended solely for your use and will be your responsibility to maintain. Unauthorized use of an account should be reported immediately.

Should a user misrepresent themselves, Counseling Washington reserves the right to terminate the account and deny site access should it be deemed necessary or appropriate.

All Rights Reserved

We reserve all rights to all materials on the Site, including, without limitation, written content, graphical and design elements (including the Site’s “look and feel”), and service marks and trademarks. By submitting material to any section of the Site, you automatically grant, or warrant that the owner of such material has expressly granted, to us the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. You may not sell, transfer or assign any products or services or your rights to any products or services provided by us to any third party without our express written authorization. You may not copy, modify, alter, or excerpt (or encourage or help others to copy, modify, alter, or excerpt) the Site materials. You may not use (or encourage or help others to use) the Site for any purpose or in any manner that is prohibited by these Terms of Use or by applicable law. You acknowledge and agree that these Terms of Use in no way convey any right, title or interest to you in any materials on the Site, including, without limitation, any statutory or common law copyright, patent or other intellectual property right in such materials.

COUNSELINGSEATTLE, LLC--doing business as COUNSELING WASHINGTON-- STRIVES TO PROVIDE THE HIGHEST QUALITY OF INFORMATION TO MENTAL HEALTH AND BEHAVIORAL SCIENCES PROFESSIONALS AS WELL AS THE GENERAL PUBLIC. COUNSELING WASHINGTON DOES NOT TAKE RESPONSIBILITY FOR THE CONTENT OR ACCURACY OF INFORMATION THAT IS CONTRIBUTED BY USERS OF COUNSELINGSEATTLE.COM OR ITS NETWORKED WEBSITES. WHILE COUNSELING WASHINGTON WELCOMES AND ENCOURAGES THE CONTRIBUTION OF SUCH INFORMATION, THOSE CONTRIBUTING SUCH INFORMATION ARE INDIVIDUALLY RESPONSIBLE FOR THE CONTENT AND ACCURACY OF SUCH INFORMATION.
COUNSELORS WHO ADVERTISE ON COUNSELING WASHINGTON OR ITS NETWORKED WEBSITES AGREE TO RELEASE AND INDEMNIFY COUNSELING WASHINGTON OR ITS NETWORKED WEBSITES FROM ALL LIABILITY AND CLAIMS THAT MAY ARISE OUT OF, OR BE RELATED TO, THEIR COUNSELING AND RELATED ACTIVITIES.

CONCERNING THE INFORMATION AND SERVICES PROVIDED BY COUNSELING WASHINGTON OR ITS NETWORKED WEBSITES, COUNSELINGSEATTLE LLC MAKES NO WARRANTIES, EITHER EXPRESS OR IMPLIED, AND SPECIFICALLY DISCLAIMS ANY WARRANTY OF MERCHANTABILITY OR WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. ADDITIONALLY, COUNSELINGSEATTLE, LLC WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT CONSEQUENTIAL, PUNITIVE OR OTHER SPECIAL DAMAGES (“NON-DIRECT DAMAGES”) RESULTING FROM THE NEGLIGENCE OF COUNSELINGSEATTLE.COM OR ANY OF OUR OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS. Indemnification

Client agrees to defend, indemnify, and hold harmless Counseling Washington, its affiliates, and their respective directors, officers, employees, and agents from and against all claims and expenses, including attorneys' fees, arising out of the use of Counseling Washington by Member or Member’s Account.

Copyrights

We respect the rights of all copyright holders. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide Counseling Washington the following information required by the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act, 17 U.S.C. §512.

a) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

b) Identification of the copyright work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

c) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.

d) Information reasonably sufficient to permit us to contact the complaining party.

e) A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

f) A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Notices

All notices shall be sent to us by mail or by email to our contact information listed on the web site and addressed to the attention of LEGAL. Response notices to you will be sent by mail or by email to the address(es) you provide when registering. Notices shall be deemed given on the day actually received by recipient, if received as provided in this paragraph before 5pm on a business day in the recipient’s location. Notices received after 5pm or on a non-business day shall be deemed received on the next business day.

Amendment

Counseling Washington reserves the right to modify or change the Terms and Conditions at any time including but not limited to adding or increasing fees and making changes in its Terms of Use and Services. Any such changes, modifications, additions or deletions shall be effective immediately upon notice whether or not email notification was also received. Information dissemination may be presented to its Users or Members including but not limited to posting on Counseling Washington’s website, sending electronic notification or conventional mail or any other means. Any use by its Members after such notice signifies and constitutes that the advertiser accepts any of these changes, modifications, or additions.

Licensure Verification

Licensed Advertisers on website pages are verified by Counseling Washington staff to have current, active licenses with no outstanding judgments against the advertiser. Counseling Washington therefore reserves the right to deny or remove any advertiser not in compliance with Washington State law or that may have a judgment against them. It is the responsibility of the advertiser to update their licenses annually and fulfill Washington State mandated education to maintain licensure. Advertisers can expect to be removed from the website immediately if not in compliance with State law. Upon discovery of licensure lapse, every effort will be made by Counseling Washington to contact the advertiser to update their information. Lack of timely response may result in suspending the listing until which time the issue can be resolved or removal of the listing may occur immediately at Counseling Washington’s discretion.

Content Updates

In an effort to maintain the most frequently asked questions, industry updates and other content, Counseling Washington reserves the right to update and post consumer and counselor/therapist questions on its Website. Any submission, written or spoken may be posted. Consumer, advertisers and Counseling Washington will make every effort to remove identifying information before posting at any time.

Website statistics

In an effort to maintain its position and provide the best service to its customers, Counseling Washington uses Google.com/analytics to maintain statistics for its various pages. Counseling Washington does its best to provide a simple, useful web site for consumers and professionals. No warranty, stated or implied, is intended. Counseling Washington will take immediate action and research any mistakes made or published upon reporting by the public. Any suggestions made by viewers are appreciated and weighed for addition to the website that would make the site more useful.

Payment

It is the sole responsibility of the advertiser to update and keep current their credit card information. Counseling Washington is a subscription-based advertising web site. Acceptable payment method is through credit card purchase. Users provide their credit card information at the time of requesting a service. Billing occurs online, automatically and immediately upon submission of a listing. Subsequent billing cycle occurs monthly starting from the date the ad was submitted.  It is the User’s sole responsibility to maintain and update the credit card information. Upon billing, if the card on file is declined, expired, etc. the listing will be removed immediately and automatically. It is assumed that the User has express permission to use the credit card on file regardless of the name shown on the credit card. Counseling Washington will collect on any services rendered regardless of the credit card holder’s name.

As a Member, you will need to provide credit card information online. By entering the credit card information into Counseling Washington’s website, you  agree that you are an authorized user of said account and when a payment is made to us, you agree as part of our service, that (i) any credit information you supply is true and complete, (II) charges incurred by you will be honored by your bank or credit card company, (iii) you will pay the charges incurred by you at the current prices, including taxes if applicable, and (iv) if your initial payment is dishonored, you will provide an alternate credit card with which to pay the charges incurred, including any surcharge we may incur due to such dishonored payment.

Cancellations

Counseling Washington, its employees, affiliates, etc or Members may terminate this Agreement at any time. Without limiting the foregoing, Counseling Washington shall have the right to immediately terminate Member’s Account in the event of any conduct by the Member which Counseling Washington, in its sole discretion, considers to be unacceptable, or in the event of any breach by Member of this Agreement. The provisions of Sections covering any and all copyright material and information, intellectual property, Monitoring, Limit of Liability and Indemnification sections shall remain intact regardless of termination of this Agreement.

Cancellations are made ONLY through the online system.  It is the sole responsibility of the customer to log into their account and cancel their listing.  Cancellation by phone or email disqualifies any refund possibility, regardless of a warranted refund. Informal cancelations made using email or telephone calls will not guarantee that the listing is canceled, removed from the website or stop future payment processing.  To ensure stopping all future payment and removal of the listing(s) from the website, User MUST log into their account select “cancel” for each listing.

Billing

The BILLING CYCLE for Counseling Washington begins on the date that the Advertiser submits the listing. The date of submission becomes the monthly anniversary date and bills online, automatically, until the listing is canceled. Billing information is pulled from the Advertiser information from the credit card information form. By entering the credit card information, it is assumed that the Advertiser has express or written permission to use the card information provided.

Refund Policy

Refunds are at the sole discretion of Counseling Washington and its employees. If a billing error has been made, Counseling Washington will correct any error made by the company or its employee however it is at the discretion of Counseling Washington to research and determine if a refund is applicable or warranted. No refunds will be issued for any service rendered after the 3rd day of any given month. Trying to cancel your listing(s) by email or phone forfeits any right you may have had to a refund.  It is the sole discretion of Counseling Washington whether or not to issue a refund if this procedure is not followed.

Trademarks

Counseling Washington owns all rights to its name and logo. All rights are reserved. All other trademarks appearing on the website are the property of their respective owners. Use of the Counseling Washington’s Website logos, graphics or Services does not grant any right or license to use logos or trademarks found herein.

Third Party Content

Counseling Washington is a licenser or distributor (and not a publisher) of content supplied by third parties and its Members. Accordingly, there are some cases in Counseling Washington has no more editorial control over such content than does a public library, bookstore, or newsstand. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers, Counseling Washington Blog authors, Clients, or any other user of counselingwashington.com, are those of the respective author(s) or distributor(s) and not of Counseling Washington.

Neither Counseling Washington nor any third-party provider of information guarantees the accuracy, completeness, or usefulness of any content, nor its merchant ability or fitness for any particular purpose.

In many instances, the content available through Counseling Washington represents the opinions and judgments of the respective information provider, Client, or other user not under contract with Counseling Washington. Counseling Washington neither endorses nor is responsible for the accuracy or reliability of any opinion, advice, or statement made on counselingwashington.com by anyone other than authorized Counseling Washington employee spokespersons while acting in their official capacities.

Under no circumstances will Counseling Washington be liable for any loss or damage caused by a Client's reliance on information obtained through counselingwashington.com. It is the responsibility of Client to evaluate the accuracy, completeness, or usefulness of any information, opinion, advice, or other content available through counselingwashington.com. Please seek the advice of professionals, as appropriate, regarding the evaluation of any specific information, opinion, advice, or other content.

Advertisements and Links

Counseling Washington will not endorse content on any third-party websites and additionally is not responsible for the content of linked third-party sites, sites framed within Counseling Washington’s website, or third-party advertisements, and does not make any representations regarding their content or accuracy.

Client's use of third-party websites is at the viewer’s own risk and subject to the terms and conditions of use for such websites nor does Counseling Washington endorse any product advertised on its website.
